Definitions

“The Photographer”, “Vendor”, and “Vendor Personnel” shall mean Bryce Ramos trading as Bryce Ramos Photography and his associates.

“Client” shall be those persons defined as subjects and customers.  

“Photography Services”, “Services”, “Photography”, and “Products” shall refer to photography services and products as outlined in their respective description pages throughout this website and at checkout.

Collectively, all of the above people or businesses entering this Agreement will be referred to as the "Parties." These terms cannot be varied in any way by the Clients unless such conditions are expressly agreed to by the photographer in writing.

Copyright & Usage

The copyright Designs and Patents Acts assign the copyright of the images to the Photographer. All images and copyright are the property of Bryce Ramos Photography and may not be reproduced in any manner without explicit written permission.

When purchased, edited digital photography files are for personal use only and may be reproduced for the purpose of sharing with friends and family.  In the event that these photos will be published, sold for profit, and/or used within marketing materials, the Client must obtain written permission from and compensate Bryce Ramos Photography prior to release. Photography services for commercial use must be negotiated and agreed-upon by both parties separately and in writing.

Client grants Bryce Ramos Photography unrestricted usage rights and copyrights to use, edit, and publish photographs in any manner or medium. Client grants Bryce Ramos Photography permission to use images taken within photography sessions in sample albums, marketing materials, publications, competitions, online web presences, including but not limited to, websites, social networks, blogs, etc.

Creative License

Images are edited at the photographer’s discretion, and delivered galleries may not include all images shot. The photographer reserves the creative right to edit and release only those deemed creditable as professional in quality and within the photographer’s artistic standards.  Client may request further editing changes for an additional charge.

Payments

All quoted prices for photography services include a non-refundable and non-transferrable deposit totaling 50% of the package price.  This deposit is due at booking, as well as full acceptance of the terms and conditions as published on the photographer’s website, to secure a spot on the Photographer’s schedule.  Any remaining balance is due before the Client’s session begins.

Rescheduling and Fees

If available, one (1) rescheduling request is accepted free of charge up to 72-hours before the scheduled appointment and needs to be made in writing by emailing bryce@bryceramos.com.  Any rescheduling requests made within 72-hours of the appointment will be assessed a rescheduling fee of 50% of total package price of Service.

After the first request, any rescheduling requests will be assessed a rescheduling fee of 50% of total package price of Service. 

Bryce Ramos Photography reserves the right to reschedule for any reason.  Appointments will be rescheduled for the next available date agreed upon with the Client.  If it is not possible to reschedule the photography session canceled by Bryce Ramos Photography, the Client will receive a full refund limited to all payments received.

Cancellations and No-Shows

Cancellations can be made in writing by emailing bryce@bryceramos.com.  No-shows will be considered a cancellation.  A refund minus the non-refundable deposit of 50% of total package price of Service will be issued.

Session Start Time

The session will start at the scheduled start time even if the Client is tardy or unprepared. The session end time will remain the same. If additional time is needed, the Client will have the option to purchase based on availability and existing pricing.

On The Day

The Photographer will be the sole professional photographer at the studio specified.

Photographs taken during a session will be at the discretion of the Photographer although every effort will be made to comply with the Clients requirements.  Special requests are not binding instructions, although every effort is made to comply with the Client's wishes. The Photographer will do their best to honor the requested photographs but do not undertake to guarantee any specific picture nor incorporate any specific background, location, group arrangements, or aesthetic element.

Due to a variety of lighting conditions and the limitations of digital sensors, some colors may alter throughout a set of photographs.

Although all equipment is checked regularly and reasonable steps are taken to ensure backup equipment is available, the photographer will not be responsible for photographs that are not produced due to technical failure.

Guests: Client may bring one guest with them to the appointment. They must remain in the designated studio space during photography session. Client assumes liability for their guest’s actions and cooperation.

Cooperation: Bryce Ramos Photography is not held responsible for any Client’s behavior or failure to cooperate during the photography session.   If the desired outcome of a Client’s session is jeopardized by the behaviors of parties involved, with the exception of Vendor personnel, the Vendor cannot be held responsible.

Personal Accident: Any directions issued to Clients, their guests or employees during a photographic shoot are deemed to be at said persons’ own risk. The Photographer cannot be held responsible for any personal accidents during a photographic shoot.

Participation of Dogs (If Applicable)

Dog Vaccinations: The Client specifically represents that their dog has not been exposed to rabies or distemper and has not been ill with any communicable condition within a 30-day period prior to the receipt of Services. Also, the Client ensures the dog is in good health and is current on required vaccinations and a flea preventative.  The Client must have an up-to-date certificate of vaccination on hand and ready to display at the request of the Photographer.

Dog Behavior: The Client represents that their dog has not bitten or shown any aggressive or threatening behavior toward any person or animal.  The Client understands that they are solely responsible for any harm or burdens caused by their dog to any person, other animals, or property while at the shoot.  Bryce Ramos Photography will not be responsible for any injuries that are out of Vendor’s control that the dog encounters.

Dog Cooperation: Bryce Ramos Photography has the right to terminate any appointment if a Client’s dog is deemed unable to be photographed.   This includes, but not limited to, being aggressive, or posing a risk to themselves, others, or property.  If a session is terminated, no reimbursement will be provided to Client. 

Delivery of Files

Bryce Ramos Photography will deliver edited digital photography files within 2-weeks from when a Client communicates their final photo selections from their proof set.  The total number of edited digital photography files released to Client will be based upon the agreed and paid-for Services package.  Delivery will occur electronically through either direct email or a third-party delivery system.

Image Printing

Photographer is not responsible for any prints that are not ordered directly through them. For best results, Clients with high-resolution files should order prints through a reputable lab.

Limit of Liability

Maximum Damages: Client agrees that the maximum amount of damages he or she is entitled to in any claim relating to this Agreement or Services provided in this Agreement are not to exceed the Total Cost of Services provided by Vendor.

Force Majeure: In the very unlikely events of cancellation by the photographer or of total photographic failure, liability shall be limited to a full refund of any fees paid.

Loss of Product: In the unlikely event that the digital files are lost, damaged or destroyed for reasons beyond the photographer’s control, the photographer's liability shall be limited to a full refund of any fees paid, but shall not include a refund for any products already received.

Indemnification: Client agrees to indemnify, defend and hold harmless Bryce Ramos Photography and its affiliates, employees, agents and independent contractors for any injury, property damage, liability, claim or other cause of action arising out of or related to services and/or product(s) Bryce Ramos Photography provides to the Client.
